Consent to Terms of Service
This Terms of Use (“Terms”) govern the conditions of use for “にほんごぱずる!” (hereinafter referred to as the “Service”). By agreeing to these Terms, users of the Service (hereinafter referred to as “Users”) are permitted to receive the Service. Minors must obtain the consent of their guardians before using the Service. If a minor agrees to these Terms and uses the Service, it will be deemed that the guardian has consented.
Account Data
This service does not create account data. All data is stored locally on each device.
Prohibited Activities
The user may face restrictions on using the service or legal actions if they engage in at least one of the following prohibited activities:
1.Acts that violate or may violate the Constitution, treaties, laws, ordinances, other regulations, public order and morals, or these Terms of Service.
2.Acts that infringe upon the copyrights, intellectual property rights, portrait rights, or other rights of the Service or third parties.
3.Acts of tampering with programs or data, or analyzing them through reverse engineering, reverse compilation, or any other means.
4.Acts of intentionally exploiting program glitches or failures for malicious purposes, or actions that exacerbate such glitches or failures.
5.Transmitting harmful programs such as computer viruses.
6.Acts that violate laws related to prevention of unauthorized access, or actions that disrupt the Service’s network.
7.Using external tools or similar means for unauthorized use of the Service.
8.Setting inappropriate expressions, including harassment, defamation, discriminatory remarks, or other expressions causing discomfort to third parties, in information publicly visible to third parties.
9.Impersonating the Service Provider.
10.Other acts deemed inappropriate by the Service Provider.
Disclaimer
1.The Service Provider may change, suspend, or terminate the Service at any time without prior notice to the user for the following reasons, and shall not be liable for any damages arising from such changes to the Service:
a. When maintenance of necessary systems for operating the Service is required.
b. When the provision of the Service becomes difficult due to natural disasters such as earthquakes, tsunamis, typhoons, floods, etc.
c. When the provision of the Service becomes difficult due to force majeure events such as fire, power outages, wars, riots, etc.
d. When otherwise deemed necessary by the Service Provider.
2.The Service Provider shall not be liable for any damages or compensation to users or third parties for the following:
a. Loss, disappearance, leakage, etc., of data stored in the Service.
b. System malfunctions, excessive access, or deficiencies in user devices.
c. Damages incurred by users due to unauthorized access, intrusion of computer viruses, or actions by third parties.
d. Damages caused by users to third parties through the use of the Service.
e. Social, psychological, or physical damages resulting from excessive or improper use of the Service.
f. Any other damages (including indirect damages) incurred by users through the use of the Service.
3.Users are responsible for resolving any disputes that arise between themselves and third parties through the use of the Service, at their own responsibility and expense.
4.If a user causes or is likely to cause damage to the Service due to reasons attributable to the user’s actions in using the Service, the Service Provider may claim compensation for the damages incurred from the user.
5.Users are responsible for all expenses (communication fees, etc.) incurred in using the Service, and the Service Provider has no obligation to pay for such expenses.
6.If prohibited activities as specified in the “Prohibited Activities” section of these Terms are determined to have been conducted or deemed necessary by the Service Provider, information regarding the relevant user may be shared.
Liability for Damages
If the Service Provider incurs damages due to the actions of a user, the Service Provider may claim damages from the user. In the event that a user infringes upon the rights or interests of the Service in using the Service, the Service Provider may claim damages from the user.
Intellectual Property Rights
Copyright and all other intellectual property rights regarding images, music, programs, and other content (“Content”) in this service belong to the Service Provider or respective rights holders. Users may not use or disclose Content to third parties without permission from the Service Provider and rights holders. Additionally, users must not reproduce, transmit, or engage in reverse engineering of this service without permission.
Trademarks and Others
Trademarks, logos, and service marks (“Trademarks”) displayed in this service are registered or unregistered trademarks of the Service Provider or third parties. The Service Provider does not transfer or license Trademarks on this service to users or any third party under these Terms. Users are prohibited from registering trademarks, including unregistered trademarks, related to this service. Additionally, users must not apply for registration, transfer registration rights, or exercise patent rights, utility model rights, design rights, or trademark rights (including rights to apply for patents, utility model rights, or design rights) related to this service.
Prohibition of Assignment
Users may not assign, transfer, or otherwise dispose of any rights or obligations under these Terms to any third party.
Handling of Personal Information
The “Privacy Policy” of this service shall apply.
Support
The Service Provider shall provide support for this service exclusively in Japanese. Additionally, the Service Provider shall not be obligated to respond to or take any action on inquiries, suggestions for improvement, or other proposals from users regarding this service.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Japan for all legal relations. For any litigation or disputes concerning this service or this Agreement, the Fukuoka District Court shall be the exclusive jurisdictional court of first instance.
Amendment of Terms of Service
The Service Provider may modify this Agreement without obtaining prior consent from the user. Users who continue to use this service thereafter shall be deemed to have accepted the amended terms of this Agreement.
